I. General Terms and Conditions

§ 1 Basic Provisions

(1) The following terms and conditions apply to all contracts concluded with us as the provider (Theora, represented by Melody Tiggemann via the website www.theora.eu. Unless otherwise expressly agreed, your own terms and conditions will not be recognized.

(2) A customer within the meaning of these provisions is any natural person or legal entity who places an order with us for personal or business purposes.

§ 2 Conclusion of the Contract

(1) The subject of the contract is the sale of goods.

(2) By listing a product on our website, we submit a binding offer to conclude a contract under the conditions specified in the respective product description.

(3) The contract is concluded via the online shopping cart system as follows:
Products selected for purchase are placed in the shopping cart. You can access and modify your shopping cart at any time via the navigation bar.

Once you proceed to checkout and enter your personal details as well as payment and shipping preferences, all order details will be displayed for final review.

If you select an instant payment system (e.g. PayPal, Sofort, etc.), you will either be directed to the payment provider or to an order summary page in our shop.

Before finalizing the purchase, you can review and correct your order. By clicking the "Order with obligation to pay" button, you submit a legally binding declaration of acceptance, concluding the contract.

(4) Order processing and all required communication will usually be automated by email. Please ensure the email address you provided is correct, and that receipt of emails is technically ensured and not blocked by spam filters.

§ 3 Right of Retention, Retention of Title

(1) You may only exercise a right of retention if it pertains to claims from the same contractual relationship.

(2) The goods remain our property until full payment has been received.

§ 4 Warranty

(1) Statutory warranty rights apply.

(2) As a customer, please check the goods promptly upon delivery for completeness, defects, and transport damage and notify us and the shipping company of any complaints without delay. Not complying with this does not affect your statutory warranty claims.

§ 5 Choice of Law

(1) German law applies. For consumers, this choice of law only applies insofar as it does not remove protection granted by mandatory provisions of the law of the state of the consumer’s habitual residence.

(2) The provisions of the UN Convention on Contracts for the International Sale of Goods are excluded.
